These Terms set the rules for using CloudBasedPOSSystem.com and the services Canada Communications Company (CanComCo) provides through it.

On this page

1. Acceptance of Terms

These Terms of Service (“Terms”) are an agreement between you and Canada Communications Company (CanComCo), which operates CloudBasedPOSSystem.com. “We”, “us” and “our” mean CanComCo. “You” means the person or business using the Website or Services.

By using the Website or Services, you agree to these Terms. If you don't agree, don't use the Website or Services.

Our Privacy Policy and Cookie Policy explain how we handle personal information and cookies.

2. Description of Service

CloudBasedPOSSystem.com (the “Website”) publishes reviews, comparisons and guides about cloud-based point-of-sale (POS) systems.

CanComCo also helps businesses find the right POS vendor and may earn a commission when a business it refers buys from that vendor. “Services” means the Website and our POS matching and referral services.

When a business buys a POS system from a vendor we refer it to, the vendor's own terms govern that system, including setup, training and support. If you sign a separate agreement with us, that agreement governs those services and these Terms cover anything it doesn't.

3. Eligibility

Our Services are intended for businesses and individuals who are at least 18 years of age. By using the Services, you represent that you are at least 18 years old and have the legal capacity and authority to enter into these Terms.

If you use the Services for a business, these Terms bind that business too.

We operate from British Columbia, Canada. If you use the Website from outside Canada, you're responsible for following your local laws.

4. User Conduct

You must not use the Website or Services to:

  1. Conduct or facilitate illegal, fraudulent, deceptive or unauthorized activities.
  2. Process transactions involving goods or services prohibited by applicable law or payment-provider requirements.
  3. Commit payment fraud, chargeback fraud, money laundering or other financial misconduct.
  4. Attempt to gain unauthorized access to accounts, servers, networks, databases or other systems.
  5. Introduce malware, viruses, ransomware or other malicious software.
  6. Interfere with, overload, probe, scan or attempt to circumvent the security of the Services.
  7. Scrape, reverse engineer, copy, reproduce or exploit the software, except where the law or an agreement expressly permits it.
  8. Infringe intellectual property, privacy or other legal rights.
  9. Upload unlawful, harmful, defamatory or otherwise prohibited content.
  10. Resell, sublicense or commercially exploit the Services without our authorization.
  11. Use the Services in a way that violates payment-network, acquiring-bank or third-party integration requirements.
  12. Misrepresent the identity, ownership or nature of a business.
  13. Send or facilitate spam, phishing or other abusive communications.

We may block access to the Website or Services for anyone we reasonably believe breaks these rules.

5. Intellectual Property

CanComCo or its licensors own the content on the Website, including text, images, graphics and page design. Copyright and other intellectual property laws protect this content.

You may view our pages and share links to them. You may not copy, republish, sell or create derivative works from our content without our written permission.

POS product names, logos and trademarks belong to their owners. Their appearance on the Website doesn't mean those owners endorse us.

To report content you believe infringes your copyright, see our DMCA & Copyright Infringement Policy.

7. Disclaimer of Warranties

We provide the Website, its content and the Services “as is” and “as available”. To the extent the law allows, we make no warranties or conditions, express or implied, including those of merchantability, fitness for a particular purpose or non-infringement.

We work to keep our content accurate, but POS providers can change their pricing, features and terms at any time. Confirm current details with the provider before you buy.

Our content is general information. It isn't legal, tax, accounting or financial advice.

We don't guarantee that the Website or Services will be uninterrupted, secure or error-free.

8. Limitation of Liability

To the extent the law allows, CanComCo and its owners, employees and partners aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Website or Services.

We aren't responsible for the performance of POS software, hardware or payment processing that other companies make or run, including systems from vendors we refer you to.

Our total liability for any claim relating to the Website or Services is limited to the total amount you paid to Cloud Based POS System for the Services in the 12 months before the claim arose. Our service is free for businesses, so for most visitors that amount is nothing.

Nothing in these Terms limits any liability that the law doesn't allow us to limit.

9. Governing Law and Dispute Resolution

These Terms and any dispute arising from or relating to the Website or Services will be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

If you have a concern, email us at pos@cloudbasedpossystem.com first so we can try to resolve it.

10. Changes to These Terms

We may update these Terms. The “Last updated” date at the top of this page shows when they last changed. If you keep using the Website or Services after an update, you accept the updated Terms.
